2. Response to Notices
Upon receipt of a valid DMCA notice, BuyOnline Pharmacy will take the following actions:
- Remove or disable access to the allegedly infringing content.
- Notify the content provider, member, or user who posted the material that it has been removed or disabled.
- If applicable, terminate repeat infringers’ access to the website.
3. Counter-Notification
If you believe that your content was removed or disabled by mistake or misidentification, you may file a counter-notification with us by providing the following information to our designated Copyright Agent:
- Identification of the material that has been removed or disabled and the location at which the material appeared before it was removed or disabled.
- Your contact information, including your name, address, telephone number, and email address.
- A statement that you consent to the jurisdiction of the federal court in your area and that you will accept service of process from the person who provided the original DMCA notice or an agent of such person.
- A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
- Your physical or electronic signature (typing your full name will suffice if submitting electronically).
Upon receipt of a valid counter-notification, we will forward it to the person who submitted the original DMCA notice. If the original complainant does not file a lawsuit within 10 business days, we may restore the removed content.
4. Repeat Infringers
BuyOnline Pharmacy reserves the right to terminate users or content providers who are found to be repeat infringers of copyright. We have a policy that provides for the termination, in appropriate circumstances, of users who are repeat infringers.
5. Limitation of Liability
Please note that under Section 512(f) of the DMCA, any person who knowingly misrepresents that material is infringing may be liable for damages, including costs and attorney’s fees incurred by us or the alleged infringer. If you are unsure whether the material infringes your copyright, you may want to seek legal advice before filing a notice with us.
